Shipping & Returns Policy

UK Orders

Delivery within the UK is charged on all orders as shown within these pages. The delivery costs may vary dependent on promotional offers in place but the amount to be charged will be shown on the final total before the customer can proceed with the order. In proceeding with the order it is deemed that the customer agrees with the quoted delivery costs.

Orders Outside the UK

Delivery on Overseas orders will be calculated and charged seperately. The ordering system does not calculate this charge but customers will be emailed the cost requesting confirmation of acceptance before the order is processed.

Returns Policy

We will exchange or credit any unused goods if you return them to us within 7 days of receipt. Refunds can only be given on faulty goods. Simply post your goods back to us in an unused condition, in their original packaging with any labels attached, together with a copy of your invoice and a covering letter explaining your requirements. Please quote your order number when returning goods. If in doubt please call us for advice. Postage/Carriage will be charged on all goods returned for exchange unless the goods are faulty. This does not affect your Statutory Rights. If you are returning Faulty Goods, please return them in a clean condition as we are unable to accept any soiled goods.

Conditions of Use

The following terms and conditions apply to the sale of goods to individual consumers only and are not negotiable.

1. Our Contract

1.1 These Terms and Conditions govern the supply of goods sold by A.Branthwaite (Gunsmiths), 6 & 8 Ravenoak Road, Cheadle Hulme, Cheshire, SK8 7DL UK. We to the customer you, and constitute the entire and only agreement between us in relation thereto.

1.2 All orders placed are subject to acceptance by us by delivery of the goods to you at which point a legally binding contract is constituted between us. The processing of your payment and acknowledgment of your order does not constitute legal acceptance of your order.

 

2. Price & Payment

2.1 The price payable for the goods (Vat Inc) you order is as set out on our website at the time you place your order, plus any charges for delivery as set out in the order form.

2.2 Occasionally an error may occur with our website and goods may be incorrectly priced in which circumstances we will not be obliged to supply the goods at the incorrect price.

2.3 We must receive payment for the whole of the price of the goods you order and any charges for delivery, before your order can be processed unless we have agreed otherwise in advance in writing.

 

3. Delivery & Title

3.1 In the event that you have not received all the goods within the stated delivery time, you must notify us immediately.

3.2 Upon delivery of the goods to you, the goods shall be at your risk. In spite of delivery having been made, title in the goods shall not pass to you until you have paid the price for the goods in full and no other sums whatsoever shall be due to us from you.

3.3 We aim to deliver all orders within 2-7 days if the goods are in stock. If the goods you order are ‘Out of Stock’ we will send out the order to you as soon as the product becomes available again. If we cannot source the item we will contact you to inform you.

 

4. Availability

4.1 While we endeavour to hold sufficient stock to meet all orders, if we have insufficient stock to supply or deliver the goods ordered and paid for by you, we will refund you the price paid for such goods as soon as possible and in any case within 30 days.

 

5. Cancellation & Returns

5.1 You may cancel your order by giving us notice of cancellation within 7 days of the date of delivery to you. Such notice may be given by e-mail or post. If you are cancelling because of any problem with the goods, please notify us of the problem at the time of cancellation.

5.2 On cancellation for whatever reason, you must return the goods to us at your cost. Where the goods are being returned because they are faulty or incorrectly supplied, we will meet the cost of return in the UK only by second class post or any other delivery means, whichever is the least expensive. Overseas orders may be returned, but we will not meet the cost of return. You are advised to obtain a receipt of sending from the Post Office.

 

6.Liability

6.1 If you have notified us of a problem with the goods within 7 days of delivery, we will either make good any shortage or non-delivery; replace or repair any goods that are damaged or defective upon delivery; or refund to you the amount paid by you for the goods in question.

6.2 We will not be liable to you for any loss of profits, administrative inconvenience, disappointment, indirect or consequential loss or damage arising out of any problem in relation to the goods and we shall have no liability to pay any money to you by way of compensation other than any refund we make under these conditions.

6.3 This does not affect your statutory rights as a consumer, nor is it intended to exclude our liability to you for fraudulent misrepresentation or for death or personal injury resulting from our negligence.

6.4 Goods are sold for use in the UK and we make no warranties that the goods are suitable for use outside the UK, or comply with any laws, regulations or standards of any jurisdiction outside the UK.

 

7. Force Majeure

7.1 We shall have no liability to you for any failure or delay in supply or delivery or for any damage or defect to goods supplied or delivered hereunder that is caused by any event or circumstance beyond our reasonable control (including, without limitation, strikes, lockouts and other industrial disputes).

 

8. Shotguns, Rifles and Air Weapons

8.1 Shotguns can be transferred to a registered firearms dealer of your choice, dispatch will be made after payment in full has been received and receipt of your valid certificate and a current variation in the case of a rimfire/centrefire rifle purchase. An extra service charge of £45 will be made, which covers the delivery and the dealers transfer fee.

8.2 In the case of Air Weapons a shotgun certificate is not required but proof of age (over 18) is required.

8.3 Sales on commission basis (Shotguns, Rifles, Air Pistols)

If you would like us to sell your firearms on your behalf, there is an initially admin fee of £25.00. This cost is for,

  • Testing the firearm is suitable for resale and light service.
  • Taking over responsibility for your firearm. Booking the item in to our system. And paperwork informing the police authorities the firearm is no-longer in your possession.
  • Taking up a prime position on our gun rack in the gun room.
  • Quality photography / video and creating an advert for the internet.
  • Advertising the firearm on our website, plus one other leading web site.
  • RFD handling fee and paperwork. Plus carriage cost in the event the firearm is transferred to other dealer nationwide/export.

This initially fee is non-refundable in the event your item is returned to you unsold.

We will both agree an initially asking price based on the current market value for your firearm or you will provide authorisation for us to value and create the asking price for the firearm.

If a perspective buyer makes a genuine offer near to the asking price we will contact you to discuss.

Our commission is 15% of the overall selling price of the firearm inclusive of VAT.  Once your firearm is sold we contact you to make arrangements for you to receive your payment.

 

9. Knives

9.1 We do not sell knives to persons under the age of 18 proof of age is required before dispatch.

 

10. General

10.1 If any part of these conditions is invalid, illegal or unenforceable (including any provision in which we exclude our liability to you) the validity, legality or enforceability of any other part of these conditions will not be affected. This contract shall be governed by and interpreted in accordance with English law.

We endeavour to carry stock of all our range but delivery times may vary depending on the goods involved and the time of year. Should any item ordered not be available from stock every effort will be made to quote a realistic delivery time.

Prices quoted are inclusive of VAT. The VAT will be deducted from any orders placed and delivered outside the EU.

Responsibility for Local Taxes and Duties on orders sent VAT free outside the EU, lie with you the customer.

Secure Payment by Credit Cards. All online payment transactions are via the RBS Worldpay secure gateway. We do not have access to your personal information.

 

Prices
The prices shown are inclusive of the relevant Value Added UK Tax (currently 20%), however our system deducts this tax on orders placed and delivered outside the EEC. If you have created an account with us that meets this criteria, once you have logged in, the prices shown will be without the relevant tax. The responsibility for any tax levied when the order enters your country will lie with you the customer.

 

Orders by Post:
If you would prefer to send an order by post please send payment with your order. We accept either Cheque, Postal Order, Bankers Draft, Access, Delta, Mastercard, Maestro, Solo, Visa, Visa Electron or Bank Transfer.
PLEASE MAKE ALL CHEQUES PAYABLE to: A Branthwaite Gunsmiths and send to 6 Ravenoak Road, Cheadle Hulme, Cheshire, SK8 7DL, UK.

All transactions are deemed to take place within the United Kingdom and subject to the relevant United Kingdom Laws.

We have taken every care in the preparation of the content of this website , in particular to ensure that prices quoted are correct at time of publishing and all products have been fairly described. However, orders will only be accepted if there are no material errors in the description of the goods or their prices as advertised on this website. All prices are displayed inclusive of VAT.

Data Protection. Customer details are retained for the sole purpose of notifying them of sales promotions by A Branthwaite Gunsmiths and are subject to the rules of the Data Protection Laws of the UK.

All queries, requests or complaints should be directed to Mr. Arthur Branthwaite and will be dealt with by him personally.
